1. No Money Handling; Calculator Only
My Golf Gremlin is a calculator and recordkeeping tool. We do not handle, hold, transmit, escrow, collect, distribute, or process any money, value, or wagers among users of the Service. Any financial settlements between players are private arrangements solely between them. We are not a party to any wager and have no responsibility for enforcement, collection, or guarantees, and we are not a bank, money transmitter, payment processor, escrow agent, gaming operator, sportsbook, or bookmaker.
Calculations, scores, course data, handicaps, and stroke allocations shown by the Service may contain errors. You are responsible for verifying calculations before relying on them to settle any wager.
2. Assumption of Risk
Golf involves inherent risks, including but not limited to errant shots, contact with clubs or balls, slips, trips, falls, weather, lightning, motorized cart accidents, course conditions, and conduct by other players. By using the Service in connection with a golf round, lesson, or related activity, you voluntarily assume all such risks, known and unknown.
3. Release and Waiver
To the maximum extent permitted by law, you release, waive, discharge, and covenant not to sue My Golf Gremlin, a fictitious business name operating in Contra Costa County, California, and the MHodgen Golf coaching activity operated under the same name (together with their owners, employees, agents, contractors, and affiliates, the "Released Parties") from any and all claims, demands, losses, liabilities, and causes of action, known or unknown, including those based on ordinary negligence, arising out of or relating to (a) your use of the Service, (b) any wager or wager dispute, (c) calculation errors or data inaccuracies, (d) personal injury, property damage, or financial loss occurring during golf rounds, lessons, travel, or related activity, or (e) the acts or omissions of any third party, including other players or facility operators.
This release includes claims for personal injury, property damage, and economic loss, and it survives termination of your account or these documents.
4. Indemnification
You agree to indemnify, defend, and hold the Released Parties harmless from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your conduct during golf rounds or lessons, or any interactions or wagers with other players.
5. No Professional Advice
The Service and any coaching content are provided for informational and instructional purposes only and do not constitute legal, financial, tax, or medical advice. Consult a qualified professional before acting on anything you read on the Service. You should consult a physician before beginning any physical activity, including golf instruction.
6. Severability and Acknowledgment
By using the Service, you acknowledge that you have read, understood, and agreed to this Disclaimer and Release of Liability. If any provision is held unenforceable, the remaining provisions remain in full force and effect.
